Exmplar Privacy Policy
Maintaining and respecting both our clients' privacy and their customers' privacy are top priorities at Exmplar. The following outlines the policies and procedures in this area that Exmplar follows.
I. Confidentiality of Information
A. We keep each client's data and each email address confidential. Each client owns the email lists and other information it sends to us. It is important to us and to our clients that this information is kept confidential. Therefore, the contract that we sign with each client includes a confidentiality promise under which we agree not to reveal personal information to any third party except as required by law or at the specific direction of the client that owns the data.
B. We do not reveal personal information to third parties. In addition to the email addresses and other information furnished to us by our clients, we collect from our clients' customers (“consumers”) other consumer information generated from those consumers' response to emails. This information includes, but is not limited to the following:
- Email tracking information, such as the successful delivery of emails and when and how the email was viewed;
- The results of email “preference” surveys, which are surveys that we monitor on a client's behalf to find out the preferences of their customers;
- “Forward to a friend” email tracking results, which allow us to know which email recipients use a special “forward to a friend” mechanism that we sometimes include in our emails;
- Webclick monitoring results, which allows us to track when email recipients use weblinks within our emails to link to another website;
- Web coupons, which allow our clients to assess the effectiveness of email campaigns by tracking which email recipients print out their coupons and redeem them at retail locations.
We keep this information confidential. Except as required by law or at the direction of the client, this information is not revealed to any third parties.
C. We do not buy, sell, or rent lists of emails.
II. Use of Information
A. We use email lists received from our clients for the sole purpose of producing and tracking direct mail campaigns on behalf of those clients. We receive email lists and related personal information from our clients, which can include names, addresses and information about customer account activity. We use that information to generate emails, track the resulting activity and report back to the clients.
B. We track email activity to help clients measure the success of email campaigns. We track each email to determine whether it was successfully delivered. We also track whether and how each email is viewed. This helps to measure the response statistics for our clients' email campaigns. We may also use this information to perform other functions on behalf of the client, such as matching the success of an email campaign with sales information provided by the client.
C. We use log files and temporary session cookies; however, we do not collect or retain personally identifiable information. For the purposes of identifying technical problems and monitoring the success of our email campaigns we use two methods of tracking IP addresses and browser information of email recipients and visitors to our website:
- We use log files to track email recipients' clicks on weblinks within the emails that we send. These files contain the recipient's IP address, browser string and system type. The purpose of these files is to perform website performance monitoring, troubleshooting, or other diagnostics.
- We use temporary session cookies to identify activity on our website. We use these cookies only for browser session management.
III. Email Recipients' Rights
A. We require our clients to obtain consent from email recipients before we send direct marketing mail to those recipients' addresses. We believe strongly that direct marketing emails should be sent only to those recipients who wish to receive these marketing emails. Thus, we require our clients to provide email lists to us that include only email addresses of those individuals who fall into one of the following categories:
- Individuals who have directly consented to receiving emails from our client; or
- Individuals who have a prior business relationship with our clients.
We do not send emails to individuals who have given a general consent to receive direct market emails from a variety of sources, but who have not specifically consented to receive emails from our client.
B. We honor “opt-out” requests. Every email we send includes a mechanism by which a user may opt not to receive emails from a client. We collect these “opt-out” requests through a web form or through a reply email, which we then convey to the client. If we receive an “opt-out” request through an email or webform, the request takes effect immediately upon receipt of the request by our system. We process requests sent directly to a client as soon as that client forwards the request to us. Once we have processed an “opt-out” request, the email address will be permanently marked within our system as unsubscribed, and it cannot be included in future mailings for that client.
IV. Changes to Our Privacy Policy A. This privacy policy may change from time to time. Such changes will be promptly posted on this website.
